1. Who we are

Elev8 Prompts (“we,” “us,” “our”) is operated by EKM Multi-Services, LLC, based in the State of Georgia, USA. For any privacy question, contact us at connect@elev8andco.com.

2. Scope

This Policy applies to visitors and customers worldwide, including individuals in the United States, the European Economic Area (EEA), the United Kingdom, Canada, Australia, and other regions. Where local law grants stronger rights, those rights apply.

3. Information we collect

• Account information — email address and hashed password when you create an account.
• Content you create — prompts you enter, generated “super prompts,” titles, categories, tags, and platform selections saved to your Library.
• Payment information — processed by Stripe. We store a transaction reference, customer ID, and entitlement status. We do not receive or store full card numbers.
• Voice input — if you use the microphone feature, your browser performs speech-to-text locally through the Web Speech API. Audio is not uploaded to our servers.
• Technical data — IP address, browser type, device information, and basic log data collected automatically for security and reliability.

4. How we use information

• Provide, operate, and maintain the Elev8 Prompts service.
• Generate super prompts through our AI provider on your behalf.
• Process payments and grant lifetime access after purchase.
• Send transactional emails (account verification, password reset, receipts).
• Protect against fraud, abuse, and unauthorized access.
• Comply with legal obligations.

We do not sell your personal information, and we do not use your saved prompts to train AI models.

5. Legal basis (EEA/UK users)

Where GDPR or UK GDPR applies, we rely on:

• Contract — to deliver the service you signed up for.
• Legitimate interests — to keep the service secure and improve it.
• Consent — where required (e.g., non-essential cookies).
• Legal obligation — to meet tax, accounting, and compliance duties.

6. Service providers we share with

We share limited data with vetted subprocessors so the app can function:

• Supabase — authentication and database hosting.
• Stripe — payment processing.
• Lovable / Cloudflare — application hosting and delivery.
• AI model providers — used to generate prompts from your input.

We do not share your data with advertisers or data brokers.

7. International data transfers

Our providers may process data in the United States and other countries. Where required, we rely on Standard Contractual Clauses or equivalent safeguards for transfers out of the EEA, UK, or Switzerland.

8. Data retention

We keep account and prompt data for as long as your account is active. Payment records are retained as required by tax and accounting law (typically up to 7 years). You may request deletion at any time (see Section 10).

9. Security

We use encryption in transit (HTTPS), encrypted database storage, hashed passwords, and row-level access controls so users can only read their own data. No online service is perfectly secure — please use a strong, unique password.

10. Your rights

Depending on where you live, you may have the right to:

• Access the personal information we hold about you.
• Correct inaccurate information.
• Delete your account and associated data.
• Export your data in a portable format.
• Object to or restrict certain processing.
• Withdraw consent where processing is based on consent.
• Lodge a complaint with your local data protection authority.

11. California residents (CCPA/CPRA)

California residents have the right to know what personal information we collect, to request deletion, to correct inaccuracies, and to opt out of the “sale” or “sharing” of personal information. We do not sell or share personal information as defined by the CCPA.

12. Children

Elev8 Prompts is not directed to children under 16. We do not knowingly collect information from children. If you believe a child has provided us information, contact us and we will delete it.

13. Cookies & local storage

We use essential cookies and browser local storage to keep you signed in, remember your theme preference, and support the checkout flow. We do not use third-party advertising cookies.

14. Changes to this Policy

We may update this Policy from time to time. Material changes will be announced in-app or by email. The “Effective” date at the top reflects the latest revision.
